Terms of Service

Last updated October 28, 2026

These Terms of Service ("Terms") are an agreement between you and NexGen Convergent Solutions Ltd. ("Trulisted", "we", "us"). They apply to the Trulisted website and app (the "Service"). By creating an account or using the Service, you agree to these Terms. If you use the Service for a brokerage or team, you confirm you are allowed to accept these Terms for them.

1. Who can use Trulisted

  • The Service is for licensed real estate professionals and the people who work with them (assistants, coordinators, brokerages).
  • You must be at least 18 and able to enter a binding contract.
  • You must give accurate account details and keep your password, and your two-step sign-in if you use it, secure. You are responsible for activity on your account.

2. What the Service does

Trulisted helps you prepare listing marketing: photo enhancement, virtual staging, twilight and decluttered images, listing copy, flyers, emails, video reels and wide videos, social posts, listing websites and campaign pages with lead forms, seller updates, quick market analyses (CMAs), listing presentations, market updates, an agent website, an Original Photos page and a compliance checklist. Some features use artificial intelligence ("AI") and mapping services provided by third parties.

3. Your responsibilities for your advertising

You remain fully responsible for your advertising and for following the laws, regulations, MLS® rules and brokerage policies that apply to you. This includes the rules of the BC Financial Services Authority (BCFSA), other provincial and state regulators, fair-housing and human-rights laws, and anti-spam laws (CASL and CAN-SPAM).

  • Trulisted's labels, disclosures, wording checks and compliance checklist are tools to help you. They are not legal advice and do not guarantee compliance.
  • Review every output before you use it. AI can make mistakes: it can misdescribe a property, change details in a photo, or produce wording that needs editing.
  • Do not use the Service to hide defects, remove permanent features or surroundings that a buyer would want to know about, or otherwise mislead anyone about a property.
  • Keep the labels and disclosures we add to altered images, and publish or link to the original photos where the rules require it.
  • Object removal is for temporary items only (such as cars or bins). Never use it to remove anything permanent or anything about the setting a buyer would want to know.
  • CMAs are your opinion of a likely price range, based on the sales you enter. They are not appraisals. Check the comparable sales, and follow your board's and brokerage's rules before sharing sold information.
  • Sold prices: only show a sold price with your seller's consent and when your board's rules allow it.
  • People who contact you through your pages: you decide how to follow up and are responsible for doing it lawfully. Only add them to marketing lists if they agreed to it.
  • Reviews and testimonials you add to a presentation must be real, and you must have permission to use them.

4. Your content

  • "Your content" means the photos, listing details, brand kit, text and other material you upload, and the outputs we create from it.
  • You keep ownership of your content. You give us a non-exclusive, worldwide licence to host, copy, process, transform and display your content only as needed to provide, secure and improve the Service. This includes sending it to our service providers, such as AI providers, for processing.
  • You confirm that you have the rights to upload your content. For example, your photographer's licence must allow edits such as virtual staging, you must have the seller's permission to market the property, and you must have the rights to use any music you upload in your videos, including on social media.
  • Original Photos pages and published listing websites are public. Anyone with the link or QR code can see them. Images in "Just listed" emails are also hosted at public links so email programs can display them. CMA reports, seller updates and presentations you share can be opened by anyone with the link until you turn the link off. Market update pages and your website are public while they're turned on. Your website is public only while your account is on a paid plan; if the plan ends, it pauses (with its contact form) until you subscribe again.
  • Market updates must use statistics you're allowed to share (for example, your board's published figures) and are your responsibility to check before you share them. They report figures; they aren't appraisals or advice.
  • Teams: a team's listings, brand kit and leads belong to the team's account. The team owner manages who is on the team and their roles. When someone leaves a team, the listings they made stay with the team.
  • We don't use your content to advertise Trulisted without your permission.

5. Acceptable use

You agree not to:

  • break any law or anyone else's rights, including copyright and privacy;
  • upload content showing people who haven't agreed to it, or personal information you aren't allowed to share;
  • try to get around plan limits, security checks or access controls, or access other customers' data;
  • overload, scrape, reverse-engineer or resell the Service, except as allowed by law;
  • create accounts automatically or in bulk.

We may remove content or suspend accounts that break these rules.

6. Plans, billing and renewals

  • Free listing: each new account can try one listing for free, with limits (for example, a set number of credits: AI-edited photos such as staged, twilight or decluttered photos, counted one per photo delivered).
  • Paid plans (monthly or yearly) and One Listing purchases are billed through our payment processor, Stripe. Prices are shown on our pricing page and at checkout, in Canadian or US dollars, plus applicable taxes.
  • Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from the Billing page. Cancellation takes effect at the end of the current period.
  • Plan allowances (for example, listings and credits per month) reset every month, also on yearly plans, and don't carry over.
  • Group plan (teams and brokerages): a team (2 or more agents) or brokerage (5 or more agents) may ask us for a Group plan. Each agent in a Group keeps their own account, listings and data, and pays for their own account at the Group price shown on our pricing page, monthly, plus applicable taxes, less the Group's discount. A Group's discount depends on how many of its agents pay the Group price, at the discount levels shown on our Group request page. We count once a month; a bigger discount starts with each agent's next payment, and a smaller one starts only after the count has been below the level at 2 monthly checks and we've given the Group's agents 30 days' notice by email. We may change the discount levels; a change reaches each Group at its next monthly check, on the same terms. A Group discount applies only to that Group's agents and only while they're in the Group. Each Group is one team or one brokerage that we approve, and we may remove agents who aren't part of it. The team or brokerage doesn't pay for its agents, and we don't pay it any fee, commission, referral reward or credits for them. If you join a Group while on another paid plan, that plan stays as it is until the end of its current period and then moves to the Group price. Leaving a Group doesn't delete the agent's account. Group managers see each linked agent's name, email, number of new listings and credits used, never their leads, clients or listing content.
  • Credit top-up packs are one-time purchases. They're used after your plan's (or One Listing's) allowance, can't be used on the free first listing (it has a fixed allowance) and expire 90 days after purchase.
  • Freebies (free credits for referring agents or for testimonials) have no cash value, can't be transferred or exchanged, are added to your team's credits, are used after your plan's (or One Listing's) allowance, can't be used on the free first listing and expire 12 months after they're added. A referral reward needs a real, separate agent who signs up through your link and makes their first payment; self-referrals, duplicate or fake accounts don't qualify, and we may take back rewards earned that way. Testimonials must be your own honest experience; we may decline ones that are copied, off-topic or abusive. We may change or end Freebies at any time; rewards already added stay until they expire.
  • Fair use limits keep the Service fast and fair for everyone: up to 100 new listings a month per agent on "unlimited" plans (Starter includes 1 new listing a month), up to 40 credits a day per agent, up to 3 versions of the same edit per photo, up to 10 listing copy runs per listing, and results held back by our honesty review are free. We may contact you, or limit use, if an account's use is far beyond normal agent use.
  • We may change prices with at least 30 days' notice by email or in the app. New prices apply from your next renewal after the notice period.
  • Refunds are covered by our Refund Policy.

7. Third-party services

The Service relies on third parties, including hosting, database, payment, email and AI providers. Their availability and terms are outside our control. Links to other websites are for convenience only.

8. Our intellectual property

Trulisted, its software, design, logos and content (other than your content) belong to us or our licensors. These Terms don't give you any rights to them except to use the Service as allowed here.

9. Suspension and closing your account

  • You can stop using the Service and close your account at any time by contacting us.
  • We may suspend or close your account if you seriously or repeatedly break these Terms, if you don't pay, or if we must do so by law. Where reasonable, we'll give you notice and a chance to download your content first.
  • After closing, we delete your content as described in our Privacy Policy.

10. Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we make no promises that it will be uninterrupted or error-free, or that outputs will be accurate, complete or fit for a particular purpose. AI-generated images and text may contain errors and must be reviewed by you.

11. Limitation of liability

To the extent the law allows:

  • we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost commissions, lost data or damage to reputation;
  • our total liability for all claims relating to the Service is limited to the amount you paid us in the 12 months before the claim (or CA$100 if you haven't paid anything).

Some places don't allow these limits, so they may not fully apply to you.

12. Indemnity

You agree to cover our reasonable losses and costs (including legal fees) arising from your content, your advertising, or your breach of these Terms or of the law.

13. Changes to these Terms

We may update these Terms. If a change is significant, we'll tell you by email or in the app at least 30 days before it takes effect. If you keep using the Service after that, the new Terms apply.

14. Governing law

These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia have exclusive jurisdiction, unless the law where you live gives you the right to bring a claim there.

15. General

If part of these Terms can't be enforced, the rest still applies. Not enforcing a right doesn't waive it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, sale or reorganisation. These Terms, with our Privacy Policy and Refund Policy, are the whole agreement between us about the Service.
